By accessing or using any PlexisGames website, game, application, or service (collectively, the "Services"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use our Services. These Terms constitute a legally binding agreement between you ("User", "you") and PlexisGames Studio ("PlexisGames", "we", "us", "our").

You must be at least 13 years of age to use our Services. If you are under the age of majority in your jurisdiction (typically 18), you may only use our Services with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

By using our Services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all terms and conditions herein.

Some of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately at support@plexisgames.com if you suspect any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or have been inactive for an extended period, at our sole discretion.

All content within PlexisGames Services — including but not limited to games, software, artwork, music, sound effects, stories, characters, names, logos, and trademarks — is the exclusive property of PlexisGames Studio or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Limited license: Subject to your compliance with these Terms and payment of any applicable fees, PlexisGames grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial entertainment purposes.

You may not: copy, modify, distribute, sell, or lease any part of our Services; reverse engineer or attempt to extract the source code of our software; create derivative works based on our content; or use our intellectual property for commercial purposes without prior written consent.

Purchases: When you purchase a game or digital content through our website, you agree to pay the listed price plus any applicable taxes. All prices are shown in the applicable currency and are subject to change without notice.

Digital content: Upon purchase of a digital game or content, you receive a licence to use that content as described in Section 4. You do not acquire ownership of any digital content.

Refunds: Refund eligibility for games purchased directly through PlexisGames is as follows: you may request a refund within 14 days of purchase if you have played less than 2 hours of the game. Refunds for games purchased through third-party platforms (Steam, Epic Games Store, etc.) are subject to those platforms' refund policies.

We reserve the right to refuse refunds for in-game purchases, DLC, or content that has been fully consumed or redeemed.

When using our Services, you agree not to:

• — Use cheats, exploits, automation software, bots, hacks, or any unauthorised third-party software that modifies or interacts with the Services
• — Harass, threaten, bully, or defame other users or PlexisGames staff
• — Post or transmit content that is unlawful, harmful, obscene, hateful, or discriminatory
• — Attempt to gain unauthorised access to any part of the Services or other users' accounts
• — Engage in any activity that disrupts, damages, or interferes with the Services
• — Impersonate any person or entity, including PlexisGames employees or other users
• — Use the Services for any commercial purpose without our express written consent
• — Violate any applicable laws or regulations

Some of our Services may allow you to create, upload, or share content such as screenshots, fan art, game modifications, or forum posts ("User-Generated Content" or "UGC").

By submitting UGC, you grant PlexisGames a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting our Services.

You represent and warrant that your UGC does not infringe any third-party intellectual property rights, privacy rights, or applicable laws. You are solely responsible for your UGC. PlexisGames reserves the right to remove any UGC at its discretion without notice.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

PlexisGames does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Services.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLEXISGAMES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• — Your access to or use of (or inability to access or use) the Services
• — Any conduct or content of any third party on the Services
• — Unauthorised access, use, or alteration of your transmissions or content
• — Any bugs, viruses, or other harmful code transmitted through the Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) £100.

You agree to defend, indemnify, and hold harmless PlexisGames and its affiliates, officers, agents, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• — Your access to or use of the Services
• — Your violation of these Terms
• — Your violation of any third-party rights, including intellectual property or privacy rights
• — Any UGC you submit to the Services

PlexisGames reserves the right to suspend or terminate your access to all or part of the Services at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or conduct that harms other users or PlexisGames.

You may terminate your account at any time by contacting us at support@plexisgames.com. Upon termination, your licence to use the Services ceases immediately.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Brazil. If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you via email or a prominent notice on our website.

Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
